TERMS OF SERVICE

By creating an account, downloading, or using the Cornerstone Strength app, you agree to be bound by these Terms of Service provided by K&G Apps LLC ("we," "us," or "our"). If you do not agree to these terms, do not use the app.

1. Health & Safety Disclaimer

Cornerstone Strength is a tool for tracking workouts. We are not medical professionals. Consult a physician before starting any new exercise program. You use this app and perform any exercises at your own risk. K&G Apps LLC is not responsible for any injuries sustained while using the app.

2. Subscriptions & Payments

Payments are processed through the Apple App Store or Google Play Store, depending on your device. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your App Store Account Settings or Google Play subscription settings. Refund requests are subject to the policies of the respective platform.

3. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Content

You retain ownership of any content you create within the app, such as custom exercises, programs, and workout data. By using the app, you grant us a limited, non-exclusive license to store and process your content solely for the purpose of providing and improving our services.

You warrant and represent that any content you upload or create: (a) is your own original work and does not infringe the rights of any third party; (b) is complete and accurate, and not deceptive or misleading; and (c) is not illegal, unlawful, obscene, abusive, threatening, defamatory, or otherwise objectionable.

We reserve the right, at our sole discretion and consistent with applicable law, to review, edit, refuse, or remove any user content that we determine violates these terms, and to limit or revoke your access to the app accordingly.

5. Intellectual Property

All app content, including the "Cornerstone Strength" name, logo, design, and source code, are the property of K&G Apps LLC and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the app without our prior written consent.

6. Disclaimer of Warranties

The app is provided on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.

7. Limitation of Liability

To the fullest extent permitted by law, in no event shall K&G Apps LLC, its officers, directors, or employees be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising out of or in connection with your use of the app. Our total liability for any claim arising from these terms or your use of the app shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

8. Termination

We reserve the right to suspend or terminate your account at any time if you violate these terms, our community guidelines, or engage in illegal activity. You may also terminate your account at any time through the app settings. Upon termination, your right to use the app ceases immediately. Your data will be handled in accordance with our Privacy Policy.

9. Dispute Resolution

Any disputes arising from or relating to these terms or your use of the app shall first be resolved through good-faith negotiation. If a resolution cannot be reached, the dispute shall be settled by binding arbitration administered in Pima County, Arizona, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.

10. Changes to These Terms

We may modify these Terms of Service at any time. We will notify you of material changes by posting updated terms within the app or on our website and updating the "Last Updated" date above. Your continued use of the app after such changes constitutes acceptance of the updated terms. If you do not agree with the changes, you should stop using the app and delete your account.

11. Severability

If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

12. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles.
